How to file a RERA complaint in Madhya Pradesh

Which form, which officer, which papers, and what happens after you press submit, for a buyer whose registered project has gone wrong.

File it online on the MP RERA portal, on Form M or Form N, with a ₹1,000 fee. Form M goes to the Authority, for a refund with interest or interest on each month of delay. Form N goes to the Adjudicating Officer, for compensation. Choose the form by the relief you want, and gather the papers first.

First, the calm part

Most registered projects never need any of this. When one does, the buyer usually lives it as a quarrel: unanswered calls, a stalled site, a sales office that changes its story. The Real Estate (Regulation and Development) Act, 2016 replaces the quarrel with a procedure: a form, a fee, an officer and a clock.

Any aggrieved person may file, including an association of allottees. You can argue it yourself or authorise a lawyer, chartered accountant, company secretary or cost accountant. The fee is ₹1,000 a complaint, paid online.

The Adjudicating Officer is a present or former District Judge. To enforce an earlier order, use the form it came from, and only 60 days after it.

What a month of delay is worth

Once the possession date has passed, the Act prices the wait whether you stay or leave. Interest runs at the rate the MP rules prescribe, two per cent above a State Bank of India lending rate, from the date each amount fell due; the order states the figure. It is the same rate a buyer pays for paying late.

Refund, interest and compensation are payable within 60 days of falling due. Miss that, and the order may add a further two per cent as penal interest. Your own order fixes the figure.

Paper proves the facts: build the folder first

Both forms end with a list of enclosures. Put these in one folder, in date order:

  • The registered agreement for sale. A promoter may not take more than 10 per cent before one is registered.
  • The allotment letter: the unit, its number, its price.
  • Every payment receipt, with matching bank statements.
  • The promised possession date, with the clause number.
  • Every letter and email with the promoter.
  • The project's RERA registration number. Form N asks for it outright.

What to write: short, dated, specific

Form M has nine headings: your details and an address for notices; the promoter's details; why RERA applies; the facts, with dates; the relief and the section relied on; any interim order sought; that the matter is not pending elsewhere; the fee paid; the enclosures. Form N follows the same shape.

The facts should fit in four lines. A template, filled with your own figures:

Agreement dated [date] promised possession by [date] under clause [number]. I have paid ₹[amount] of ₹[total]. No possession has been offered as of [date]. I seek interest for every month of delay under section 18(1).

What happens after you submit

  1. Filed and paid online on Form M or N, with the ₹1,000 fee.
  2. Checked for admissibility. It cannot be rejected without first hearing you.
  3. Notice to the promoter, by email for a registered project.
  4. Hearing, on documents and evidence, with a site inspection if one is needed.
  5. The order, due within 60 days; if it takes longer, the reasons are recorded.
  6. Recovery. If the promoter does not pay within 60 days, the District Collector recovers the amount as arrears of land revenue.
  7. Appeal, within 60 days, to the Appellate Tribunal. A promoter who appeals must first deposit money with the Tribunal: at least 30 per cent of any penalty, or the amount due to the allottee with its interest and compensation, as the Act lays down.

Four things a complaint cannot do

  • Fix compensation on Form M. Only the Adjudicating Officer awards compensation, on Form N.
  • Help a tenant. The Act's "allottee" excludes a person given the unit on rent.
  • Run beside a case elsewhere. You declare that the matter is not pending before any other court or forum.
  • Collect the money itself. An unpaid order goes to the District Collector for recovery.

What is the fee to file a RERA complaint in Madhya Pradesh?

₹1,000 per complaint, on Form M or on Form N, paid online on the MP RERA portal when you file.

Which form do I use to claim interest for delayed possession from MP RERA?

Form M, to the Authority, under the proviso to section 18(1), if you want to keep the flat and be paid interest for each month of delay until possession.

Can MP RERA give me compensation for a delayed flat?

Compensation is decided by the Adjudicating Officer, a present or former District Judge, on Form N under section 71. The Authority does not award it on Form M.

Can a tenant file a RERA complaint against the builder?

No. The Act's definition of an allottee excludes a person given the unit on rent.

What happens if the builder does not pay after the RERA order?

After 60 days the amount can be recovered by the District Collector as arrears of land revenue.
