Freehold or leasehold: the difference that does not show on the plot

What separates owning land from holding it on a lease, what nazul means in Madhya Pradesh, and the four lines of a lease deed to read before you agree a price.

Freehold land is yours outright, with no end date. Leasehold land is held for a fixed term from its owner, often the state, on conditions written into the lease. Both are lawful, and both are sold in Indore. The difference rarely shows on the plot, but it decides what you can sell, mortgage and build.

Two ways to hold land

A lease, in the words of the Transfer of Property Act, transfers a right to enjoy property for a period, in return for a premium, a rent or both. It does not transfer ownership. The owner, called the lessor, keeps the land and gets it back when the term ends. The lessee holds and uses it in the meantime, on the lease's terms.

Plenty of good property in every Indian city is leasehold, and there is nothing wrong with buying it. The mistake is paying a freehold price for a leasehold plot without knowing you did.

Nazul: the word you will hear

In Madhya Pradesh the leasehold land a buyer meets most often is nazul. The state's Revenue Department describes nazul land as land owned by the government and usually given out on lease to a person or an institution, not sold to them. It is most common in the older, denser parts of the state's cities, where it was allotted to occupants long ago.

A nazul lease can, in many cases, be converted to freehold. The state has issued instructions on how nazul land is dealt with, the current set dating from 2020, and the terms have changed more than once over the years. So treat any conversion charge, date or procedure you are quoted, by anyone, as something to confirm with the Collector's office or the local body before it goes into your price.

Everything that matters is written in the lease deed. Four lines decide what you are really buying.

1. How many years are left

A lease ends when its term runs out. A plot with twelve years left on its lease is a very different asset from one with seventy, even if the two look identical from the road. Read the start date and the term, do the arithmetic, and then read what the deed says about renewal.

2. Whether a transfer needs permission

The general law lets a lessee transfer their interest unless the lease says otherwise. Government leases often do say otherwise: they require the lessor's consent before a sale, and that consent can come with a fee. If permission is needed, find out whether it has been given for your sale, in writing.

3. What use is allowed

A lease granted for a home and used as a shop can be in breach for years before anyone notices. A lease can provide that the lessor may take the land back if an express condition is broken, and the Act recognises that ending. You inherit the use as it stands, along with any breach that comes with it.

4. Whether the ground rent is paid up

Ask for the latest receipts. Unpaid rent is a breach of the lease, and the person holding the lease when the lessor acts is the one who deals with it, whoever let the arrears build up.

Expect the bank to read the same four lines

A lender looks at what it is lending against. With a leasehold plot, that means the remaining term, the transfer conditions, the permitted use and the rent position. Reading them before the bank does costs you nothing. It also tells you in advance whether the loan you are counting on fits the plot you are choosing.

One question, asked early: is this freehold, or is it leasehold? It is an ordinary question, and an honest seller answers it in a few words. If the answer is "same thing hai", it is not the same thing. Either the person does not know, or they would rather you did not.

Then stop relying on the answer and look at the document. A sale deed and a lease deed say which they are on their first page. If what you are shown is a lease, or a deed that hands over the remainder of one, you are buying the rest of a term, not the land.
